As the population across the country ages, assisted living is becoming the community of choice for aging in place. Resident care litigation risk has been emerging with more frequency as the mission and vision of assisted living communities evolve. Person-centered care is a central philosophical aim of the assisted living movement, and the acuity levels of residents are higher, and needs are increasing through the residency. As in nursing homes, accidents or clinical problems at assisted living centers can translate into liabilities. Many of the losses that drive claims occur during transitions in care from the home to the hospital to the assisted living/memory care and to skilled nursing.
